It all started with Zubulake and the Russian Mafia.

We were working on a project for a client that was having issues... real, big business, data security issues. Someone, unbeknownst to them, had been hacking into their network and doing... well, no one really knew what they were doing. You see, the client had no data security in place. But, they knew something wasn't right... and they needed to figure it out. As a small business, if their clients (Fortune 500 Manufacturing and Service companies) found out, they would be out of business.

Not bank accounts, the hackers were watching customer orders to buy and sell stock!

After consulting with them on proper data security measures, we came to see many tell-tale signs of Eastern European hackers. But the odd thing was, they weren't pillaging bank accounts. The hackers were doing something else. It looked like they were watching the financial books closely... very closely. After a while, we figured out that the hackers were interested in customer orders. Why would they be interested in our client’s customers? Not just 1 customer, mind you. Many customers. Why would they care who our client worked with? What was in it for them? Then we realized that the customer data the hackers were in we all publicly traded businesses!

The Zubulake decisions (Zubulake v. UBS Warburg LLC, 217 F.R.D. 309, 311[S.D.N.Y. 2003) have set the standards and opened the doors to the utilization of computer forensics in civil proceedings.
